Please read these Terms & Conditions carefully before using the VetSimple platform. By creating an account or using our services, you agree to be bound by these terms.
1. Definitions
"Platform" means the VetSimple website and any associated applications. "Professional" means a licensed veterinarian, registered veterinary technician, or veterinary student who registers on the Platform. "Clinic" means a veterinary practice that posts shifts on the Platform. "Shift" means a relief work engagement posted by a Clinic and accepted by a Professional. "We", "us", and "our" refer to VetSimple.
2. Eligibility
To register as a Professional, you must hold a valid licence issued by the College of Veterinarians of Ontario (CVO) or the Ontario Association of Veterinary Technicians (OAVT), or be enrolled in an accredited veterinary or veterinary technology program. You must be at least 18 years of age. You are responsible for ensuring your licence remains in good standing throughout your use of the Platform.
3. Nature of the Platform
VetSimple is a marketplace that connects Professionals with Clinics. We are not an employer, staffing agency, or party to any shift engagement. The relationship formed when a Professional accepts a Shift is directly between the Professional and the Clinic. We do not supervise, direct, or control the provision of veterinary services. Professionals are independent contractors, not employees of VetSimple.
4. Digital Platform Workers' Rights Act, 2022
VetSimple operates in compliance with Ontario's Digital Platform Workers' Rights Act, 2022 (DPWRA) where applicable. Professionals who qualify as "digital platform workers" under the DPWRA are entitled to the rights set out in that Act, including minimum wage protections, recurring pay periods, and notice of removal. Nothing in these Terms limits any rights you have under the DPWRA or any other applicable Ontario employment or labour legislation.
5. Accounts and Security
You are responsible for maintaining the confidentiality of your account credentials. You must notify us immediately at [email protected] if you suspect unauthorized access to your account. We reserve the right to suspend or terminate accounts that violate these Terms or that we reasonably believe have been compromised.
6. Acceptable Use
You agree not to use the Platform to post false or misleading information, to harass or harm other users, to circumvent our fee or payment systems, or to violate any applicable law or professional regulation. Clinics may not post shifts that require Professionals to perform services outside their licensed scope of practice.
7. Payments
Rates for Shifts are set by the Professional and agreed to by the Clinic prior to the commencement of a Shift. Payment is made directly from the Clinic to the Professional in accordance with the agreed terms. VetSimple does not hold, process, or take a percentage of shift payments. We are not responsible for payment disputes between Professionals and Clinics.
8. Limitation of Liability
To the maximum extent permitted by applicable law, VetSimple shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Platform, including but not limited to loss of income, loss of data, or professional liability arising from shift engagements. Our total liability to you for any claim shall not exceed the fees, if any, paid by you to VetSimple in the twelve months preceding the claim.
9. Changes to These Terms
We may update these Terms from time to time. We will notify registered users of material changes by email or by posting a notice on the Platform. Continued use of the Platform after the effective date of any changes constitutes your acceptance of the revised Terms.
10. Governing Law
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein. Any disputes shall be resolved in the courts of Ontario.
